Reformas a los art\u00edculos 25, 27 y 28 constitucionales en materia de energ\u00eda, internet, transporte y empresas productivas del Estado aprobadas por la C\u00e1mara de Diputados<\/strong><\/p>\n

La iniciativa con Proyecto de Decreto por el que se reforman los art\u00edculos 25, 27 y 28 de la Constituci\u00f3n Pol\u00edtica de los Estados Unidos Mexicanos, en materia de industrias estrat\u00e9gicas del Estado fue presentada el 2 de febrero del 2024 por el expresidente Andr\u00e9s Manuel L\u00f3pez Obrador y aprobada el 9 de octubre de 2024 por la C\u00e1mara de Diputados y el 17 de octubre por la C\u00e1mara de Senadores, en ambos casos con mayor\u00eda calificada.<\/p>\n

Los puntos m\u00e1s relevantes de la reforma constitucional consisten en: (i)<\/strong> reformar el art\u00edculo 25<\/strong>, sustituyendo el concepto de \u201cempresa productiva del Estado\u201d por \u201cempresa p\u00fablica del Estado\u201d y eliminando la referencia a que estas empresas se rijan por \u201cmejores pr\u00e1cticas\u201d, al considerarse un concepto propio de empresas privadas; (ii)<\/strong> reformar el art\u00edculo 27<\/strong> suprimiendo el p\u00e1rrafo que se\u00f1ala que \u201cEl Estado queda a cargo de la transici\u00f3n energ\u00e9tica\u201d <\/em>para establecer que las leyes determinar\u00e1n c\u00f3mo podr\u00e1n participar los particulares en las dem\u00e1s actividades de la industria el\u00e9ctrica, sin que las empresas privadas tengan prevalencia sobre la empresa p\u00fablica del Estado, con el prop\u00f3sito de garantizar la accesibilidad del servicio p\u00fablico de energ\u00eda el\u00e9ctrica; y (iii)<\/strong> reformar el art\u00edculo 28<\/strong> para se\u00f1alar que no constituir\u00e1n monopolios las funciones que el Estado ejerza de manera exclusiva sobre el servicio de internet que provea, entre otros, y que los objetivos de la planeaci\u00f3n y el control del Sistema El\u00e9ctrico Nacional ser\u00e1n: preservar la seguridad y autosuficiencia energ\u00e9tica de la naci\u00f3n, y proveer al pueblo de la electricidad al menor precio posible, evitando el lucro, para garantizar la seguridad nacional y soberan\u00eda a trav\u00e9s de la empresa p\u00fablica del Estado que se establezca.<\/p>\n

La reforma constitucional tiene como objetivo que, aunque los particulares podr\u00e1n participar en actividades de la industria el\u00e9ctrica, las empresas p\u00fablicas del Estado tendr\u00e1n prioridad, con la obligaci\u00f3n de garantizar la responsabilidad social, la continuidad y accesibilidad del servicio de electricidad.<\/p>\n

El Congreso de la Uni\u00f3n tendr\u00e1 un plazo de 180 d\u00edas naturales desde la entrada en vigor del decreto para adecuar las leyes secundarias correspondientes.<\/p>\n

La reforma tambi\u00e9n prioriza el desarrollo de pol\u00edticas cient\u00edficas, tecnol\u00f3gicas e industriales necesarias para la transici\u00f3n energ\u00e9tica y aclara que no se considerar\u00e1n monopolios las actividades del Estado relacionadas con el litio y los servicios de internet que \u00a0\u00e9ste provea.<\/p>\n

Para evaluar el impacto y los efectos de la iniciativa y que \u00e9sta sea ley, ser\u00e1 necesario esperar su aprobaci\u00f3n por las legislaturas de la mayor\u00eda de los Estados de la Rep\u00fablica Mexicana, as\u00ed como la promulgaci\u00f3n de la legislaci\u00f3n secundaria correspondiente.<\/p>\n

Amendment to Constitutional Articles 25, 27, and 28 on Energy, Internet, Transportation, and State Productive Companies approved by the House of Representatives<\/strong><\/p>\n

\u00a0<\/strong>The initiative, including the draft decree amending Articles 25, 27, and 28 of the Political Constitution of the United Mexican States, regarding the State’s strategic industries, was presented on February 2, 2024, by former President Andr\u00e9s Manuel L\u00f3pez Obrador and approved by supermajority vote, on October 9, 2024 by the Chamber of Deputies and on October 17, 2024 by the Senate.<\/p>\n

The most relevant points of the constitutional amendment include: (i)<\/strong> amending Article 25<\/strong> by replacing the concept of “productive state company” with “public state company” and eliminating the reference to these companies being governed by “best practices,” as this is considered a concept inherent to private companies; (ii)<\/strong> amending Article 27<\/strong> by removing the paragraph that states “The State is responsible for the energy transition”<\/em> and establishing that laws will determine how private individuals may participate in other activities of the electric industry, without private companies taking precedence over the public state company, with the aim of guaranteeing the accessibility to public electrical services; and (iii)<\/strong> amending Article 28<\/strong> to specify that the actions the State exercises exclusively over the internet service it provides, among others, will not constitute monopolies, and that the objectives of the planning and control of the National Electric System will be to preserve the nation’s energy security and selfsufficiency, and to provide electricity to the people at the lowest possible price, avoiding profitmaking, in order to guarantee national security and sovereignty through the public state company.<\/p>\n

The constitutional amendment aims to ensure that, while private parties may participate in the activities of the electrical industry, public state companies will have priority, with the obligation to guarantee social responsibility, continuity and access to electricity.<\/p>\n

The Congress will have a period of 180 calendar days from the entry into force of the decree to amend the corresponding secondary laws.<\/p>\n

The amendment also prioritizes the development of the scientific, technological, and industrial policies necessary for the energy transition and clarifies that State activities related to lithium and the internet services it provides will not be considered monopolies.<\/p>\n

To assess the impact and effects of the initiative and for it to become law, it will be necessary to wait for its approval by the legislatures of the majority of the States of the Mexican Republic, as well as the enactment of the corresponding secondary legislation.<\/p>\n
