{"id":18214,"date":"2025-08-11T12:29:10","date_gmt":"2025-08-11T18:29:10","guid":{"rendered":"https:\/\/www.nhg.mx\/?p=18214"},"modified":"2025-09-24T18:27:40","modified_gmt":"2025-09-25T00:27:40","slug":"gran-simplificacion-para-proyectos-de-autoconsumo-interconectado-en-mexico","status":"publish","type":"post","link":"https:\/\/www.nhg.mx\/en_gb\/gran-simplificacion-para-proyectos-de-autoconsumo-interconectado-en-mexico\/","title":{"rendered":"CNE emite nueva regulaci\u00f3n para el autoconsumo interconectado en centrales de 0.7 a 20 MW"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">El 6 de agosto de 2025, la Comisi\u00f3n Nacional de Energ\u00eda (\u201cCNE\u201d) public\u00f3 en el Diario Oficial de la Federaci\u00f3n (\u201cDOF\u201d) el acuerdo por el que se establecen los requisitos para obtener un permiso de generaci\u00f3n para autoconsumo interconectado en centrales el\u00e9ctricas cuya capacidad sea de entre <\/span><span style=\"font-weight: 400;\">0.7 a 20 megawatts (\u201cMW\u201d).<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">La CNE ha simplificado los requisitos para la obtenci\u00f3n del permiso de generaci\u00f3n en esta modalidad, de manera que:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La documentaci\u00f3n corporativa requerida se ha reducido.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se utiliza un formato \u00fanico y simplificado, en lugar de m\u00faltiples anexos de control corporativo.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Solo se requiere un diagrama general de la estructura accionaria y corporativa, que incluya los porcentajes de participaci\u00f3n y la identificaci\u00f3n de quienes ejercen control directo.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Un plan de negocios simplificado si la central el\u00e9ctrica no est\u00e1 instalada.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Basta con un diagrama simplificado de obras que indique el inicio, terminaci\u00f3n y fecha de operaci\u00f3n comercial, en lugar de un programa detallado.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ya no es necesario presentar fichas t\u00e9cnicas de los equipos ni informaci\u00f3n t\u00e9cnica adicional sobre la tecnolog\u00eda o proveedores utilizados.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">No se exige detallar la producci\u00f3n anual neta y bruta de energ\u00eda; \u00fanicamente se requiere la capacidad de la central y la generaci\u00f3n anual estimada.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Solo debe presentarse el n\u00famero de acuse de recepci\u00f3n o, en su caso, el n\u00famero de resolutivo definitivo de la nueva autorizaci\u00f3n en materia de Manifestaci\u00f3n de Impacto Social del Sector El\u00e9ctrico.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">No se requiere presentar el estudio de impacto del Centro Nacional de Control de Energ\u00eda (\u201cCENACE\u201d), basta con proporcionar el n\u00famero de oficio que informe los resultados del estudio correspondiente.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se permite la presentaci\u00f3n de estados financieros no auditados correspondientes a al menos los dos a\u00f1os anteriores a la solicitud.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ya no se requiere acreditar experiencia t\u00e9cnica mediante documentaci\u00f3n detallada ni evidenciar recursos propios o contratados; ahora es suficiente con demostrar experiencia general en proyectos similares.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sin embargo, ahora es necesario se\u00f1alar la denominaci\u00f3n de cada una de las usuarias de la red particular asociada a la central, conforme a la Ley del Sector El\u00e9ctrico (\u201cLSE\u201d).<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Bajo la abrogada Ley de la Industria El\u00e9ctrica, la figura de abasto aislado con interconexi\u00f3n a las Redes Generales de Distribuci\u00f3n o a la Red Nacional de Transmisi\u00f3n, actualmente regulada como autoconsumo interconectado conforme a la nueva LSE, requer\u00eda la presentaci\u00f3n de una carga documental considerablemente m\u00e1s extensa.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Antes de la emisi\u00f3n de esta nueva regulaci\u00f3n, se requer\u00eda una serie de documentos detallados para respaldar la solicitud, incluyendo informaci\u00f3n sobre la estructura del capital social, el grupo econ\u00f3mico del solicitante, participaciones accionarias en fideicomisos, estados financieros auditados por contador p\u00fablico registrado ante el SAT, plan de negocios con detalles espec\u00edficos, tipo de control corporativo, montos de inversi\u00f3n justificados, plan de financiamiento, acuse de recibo de la Evaluaci\u00f3n de Impacto Social con los anexos correspondientes, el estudio de impacto del CENACE relacionado con la interconexi\u00f3n el\u00e9ctrica, entre otros.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">El Acuerdo entrar\u00e1 en vigor cuando los Reglamentos de la LSE y de la Ley de Planeaci\u00f3n y Transici\u00f3n Energ\u00e9tica tambi\u00e9n entren en vigor. only the plant\u2019s capacity and estimated annual generation must be provided.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Only the acknowledgment receipt number or, as applicable, the final resolution number for the new Social Impact Assessment for the Electric Sector must be submitted.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Submission of the National Energy Control Center (\u201cCENACE\u201d) impact study is no longer required; it is sufficient to provide the official reference number reporting the results of the corresponding study.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Unaudited financial statements for at least the two fiscal years prior to the application are now accepted.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Detailed documentation proving technical experience or evidence of own or contracted resources is no longer required; general experience with similar projects is now sufficient.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The name of each user of the private network associated with the plant must now be provided, in accordance with the Electric Sector Law (\u201cLSE\u201d).<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Under the now-repealed Electric Industry Law, isolated supply projects with interconnection to the General Distribution Grids or the National Transmission Grid, now regulated as interconnected self-supply under the LSE, required the submission of a significantly more extensive set of documents.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Prior to the issuance of this new regulation, applicants were required to submit detailed supporting documentation, including information on the share capital structure, the applicant\u2019s economic<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\">group, shareholdings held in trusts, audited financial statements prepared by a certified public accountant registered before the Mexican Tax Authority (SAT), a detailed business plan with specific information, the type of corporate control exercised over the applicant, substantiated investment amounts, a financing plan, the acknowledgment receipt for the Social Impact Assessment with the corresponding exhibits, the CENACE impact study related to the plant\u2019s interconnection, among other items.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The Resolution will enter into force when the Regulations of the LSE and the Planning and Energy Transition Law also enter into force.
