{"id":18437,"date":"2025-10-03T13:30:56","date_gmt":"2025-10-03T19:30:56","guid":{"rendered":"https:\/\/www.nhg.mx\/?p=18437"},"modified":"2025-10-10T13:46:59","modified_gmt":"2025-10-10T19:46:59","slug":"ejecutivo-federal-presenta-iniciativa-para-un-nuevo-marco-juridico-de-aguas","status":"publish","type":"post","link":"https:\/\/www.nhg.mx\/en_gb\/ejecutivo-federal-presenta-iniciativa-para-un-nuevo-marco-juridico-de-aguas\/","title":{"rendered":"Ejecutivo Federal presenta iniciativa para un nuevo marco jur\u00eddico de aguas"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">El 2 de octubre del 2025 se dio a conocer la iniciativa por la que se propone reformar la Ley de Aguas Nacionales (\u201c<\/span><b>LAN<\/b><span style=\"font-weight: 400;\">\u201d) y expedir una nueva Ley General de Aguas (\u201c<\/span><b>LGA<\/b><span style=\"font-weight: 400;\">\u201d) (en conjunto, la \u201c<\/span><b>Iniciativa<\/b><span style=\"font-weight: 400;\">\u201d). La Iniciativa est\u00e1 en un periodo de consulta p\u00fablica ante la Comisi\u00f3n Nacional de Mejora Regulatoria.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El nuevo marco jur\u00eddico conllevar\u00e1 un cambio de paradigma en la gesti\u00f3n de los recursos h\u00eddricos y el otorgamiento de derechos para su utilizaci\u00f3n por empresas, industrias y el sector agr\u00edcola, entre otros.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dentro de los cambios m\u00e1s importantes, destacan:<\/span><b><\/b><\/p>\n<p><b>A. Modificaci\u00f3n al r\u00e9gimen de concesiones<\/b><b><\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se centraliza el otorgamiento de concesiones, asignaciones y permisos a nivel nacional en la Comisi\u00f3n Nacional del Agua (\u201c<\/span><b>CONAGUA<\/b><span style=\"font-weight: 400;\">\u201d). Los Organismos de Cuenca pasan a un plano secundario en dicho proceso.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se proh\u00edbe la transmisi\u00f3n de concesiones de agua, y en su lugar se introduce la figura de reasignaci\u00f3n de vol\u00famenes.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se crea un Fondo de Reserva de Aguas Nacionales de vol\u00famenes recuperados, sin que estos puedan considerarse para la disponibilidad.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La cuota de garant\u00eda para interrumpir la caducidad de vol\u00famenes solamente podr\u00e1 utilizarse por ocasiones limitadas, y siempre que se justifique ante la CONAGUA.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se establecen nuevos criterios para el otorgamiento de pr\u00f3rrogas, y el plazo para su solicitud deber\u00e1 ser dentro del \u00faltimo a\u00f1o de la vigencia de la concesi\u00f3n, y m\u00e1ximo 6 meses antes de su vencimiento.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se proh\u00edbe el cambio de uso del agua en las concesiones.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La captaci\u00f3n de agua pluvial para usos distintos al personal y dom\u00e9stico requerir\u00e1 de autorizaci\u00f3n por parte de la CONAGUA, y se crea un nuevo cap\u00edtulo para fomentar el re\u00faso de aguas residuales.<\/span><\/li>\n<\/ul>\n<p><b>B. Inspecci\u00f3n y multas<\/b><b><\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se ampl\u00edan las facultades de inspecci\u00f3n, verificaci\u00f3n y sanci\u00f3n de la CONAGUA, incluyendo el uso de nuevas tecnolog\u00edas y la facultad de acceder a informaci\u00f3n reservada y\/o confidencial.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se aumenta notablemente el monto de las multas (hasta un 200%), y se a\u00f1aden nuevas sanciones y delitos h\u00eddricos.<\/span><\/li>\n<\/ul>\n<p><b>C. Nuevos principios rectores del marco jur\u00eddico<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se incorpora el principio <\/span><i><span style=\"font-weight: 400;\">in dubio pro agua <\/span><\/i><span style=\"font-weight: 400;\">(ante situaciones de duda o contradicciones, prevalece el que beneficie en mayor medida el derecho humano al agua), as\u00ed como otros que regir\u00e1n la interpretaci\u00f3n de la LGA y la LAN.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Los Organismos Operadores no podr\u00e1n suspender totalmente el suministro de agua potable y el servicio de saneamiento por falta de pago, para asegurar el consumo humano m\u00ednimo.<\/span><\/li>\n<\/ul>\n<p><b>D. Disposiciones transitorias<\/b><b><\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La Iniciativa entrar\u00e1 en vigor al d\u00eda siguiente de su publicaci\u00f3n en el Diario Oficial de la Federaci\u00f3n.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La CONAGUA deber\u00e1 expedir o reformar las disposiciones reglamentarias respectivas.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Durante el plazo de 10 d\u00edas, los interesados podr\u00e1n presentar observaciones podr\u00e1n hacerlo para que sean tomadas en cuenta. En Nader, Hayaux y Goebel, contamos con un equipo de abogados especializados en derecho administrativo y recursos h\u00eddricos que puede brindar el acompa\u00f1amiento legal necesario para la presentaci\u00f3n de observaciones en esta etapa.<\/span><\/p>\n<h4><\/h4>\n<p>&nbsp;<\/p>\n<h4><b>Federal Executive presents initiative for a new legal water framework\u00a0<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">On October 2, 2025, an initiative was presented proposing to amend the National Water Law (\u201c<\/span><b>LAN<\/b><span style=\"font-weight: 400;\">\u201d) and enact a new General Water Law (&#8220;<\/span><b>LGA<\/b><span style=\"font-weight: 400;\">&#8220;) (together, the \u201c<\/span><b>Initiative<\/b><span style=\"font-weight: 400;\">\u201d). The Initiative is currently undergoing a public consultation period before the National Commission of Regulatory Improvement.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The new legal framework will bring about a paradigm shift in water resource management and the granting of rights for its use by companies, industries, and the agricultural sector, among others.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Among the most important changes are the following:\u00a0<\/span><\/p>\n<p><b>A. Modification of the Concession Regime\u00a0<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The granting of concessions, assignations, and permits at the national level is centralized in the National Water Commission (\u201c<\/span><b>CONAGUA<\/b><span style=\"font-weight: 400;\">\u201d). The Basin Organisms take a secondary role in this process.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The assignment of water concessions is prohibited, and instead the concept of volume reallocation is introduced.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A National Waters Reserve Fund is created for recovered volumes, which cannot be considered for availability.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The fee to guarantee the interruption of volume expiration may only be used on limited occasions and provided that it is justified to CONAGUA.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">New criteria are established for granting extensions, and the deadline for requesting them must be within the last year of the concession&#8217;s validity, and no later than six months before its expiration.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Changing the use of water in concessions is prohibited.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Rainwater collection for uses other than personal and domestic purposes will require authorization from CONAGUA, and a new chapter is created to promote the reuse of wastewater.\u00a0<\/span><\/li>\n<\/ul>\n<p><b>B. Inspection and Fines\u00a0<\/b><b><\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">CONAGUA&#8217;s powers of inspection, verification, and sanctioning are expanded, including the use of new technologies and the faculty to access restricted and\/or confidential information.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The amount of fines is significantly increased (up to 200%), and new sanctions and water crimes are added.<\/span><\/li>\n<\/ul>\n<p><b>C. New Guiding Principles of the Legal Framework\u00a0<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The principle of in dubio pro agua is incorporated (in situations of doubt or contradiction, the principle that most benefits the human right to water prevails), as well as others that will govern the interpretation of the LGA and the LAN.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Operating Organisms may not completely suspend the supply of drinking water and sanitation services due to non-payment, in order to ensure minimum human consumption.<\/span><\/li>\n<\/ul>\n<p><b>D. Transitory Provisions\u00a0<\/b><b><\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Initiative shall enter into force on the day following its publication in the Official Gazette of the Federation.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">CONAGUA shall issue or amend the respective regulatory provisions.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">During a period of 10 days, interested parties may submit comments for consideration.
