{"id":4365,"date":"2020-10-26T12:12:39","date_gmt":"2020-10-26T18:12:39","guid":{"rendered":"https:\/\/www.nhg.mx\/?p=4365"},"modified":"2020-10-26T12:33:27","modified_gmt":"2020-10-26T18:33:27","slug":"supreme-court-upholds-suspension-of-electricity-policy","status":"publish","type":"post","link":"https:\/\/www.nhg.mx\/en_gb\/supreme-court-upholds-suspension-of-electricity-policy\/","title":{"rendered":"Supreme Court upholds suspension of electricity policy"},"content":{"rendered":"<p class=\"x_MsoBodyTextIndent\"><span lang=\"EN-US\">On October 21<sup>st<\/sup>, 2020, the Supreme Court of Justice (<i>Suprema Corte de Justicia de la Naci\u00f3n<\/i>) upheld the suspension derived from the constitutional claim filed by the Antitrust Commission (\u201c<b><u>COFECE<\/u><\/b>\u201d) on June 22<sup>nd<\/sup>, 2020, which argued that the \u201c<i>Policy of Reliability, Safety, Continuity and Quality in the National Electric System\u201d<\/i>\u00a0issued by the Ministry of Energy (the &#8220;<b><u>SENER Resolution<\/u><\/b>&#8220;)\u00a0breaches fundamental competition and free market principles that are mandated by the Mexican Constitution. Therefore, the SENER Resolution will remain suspended until a final resolution is issued.<\/span><\/p>\n<p class=\"x_MsoBodyTextIndent\"><span lang=\"EN-US\">The SENER Resolution has been perceived as the most significant measure by the current Mexican federal administration to favor the Federal Electricity Commission (the &#8220;<b><u>CFE<\/u><\/b>&#8220;) as a State-owned company, so that CFE regains control of the electricity market instead of applying the free market rules set forth in the electricity laws in Mexico. It imposes new restrictions for the interconnection of renewable power plants to the electricity grid, in order to favor and prioritize the interconnection of conventional power plants owned by CFE. In addition, the SENER Resolution imposes roadblocks for the issuance of new generation permits, while strengthening the functions of the Ministry of Energy (SENER), the National Center of Energy Control \u00a0(CENACE) and CFE to plan and operate the electricity grid.<\/span><\/p>\n<p class=\"x_MsoNormal\"><span lang=\"EN-US\">Other recent developments include a resolution issued by the Energy Regulatory Commission (CRE) on October 7<sup>th<\/sup>, 2020 which amends previous provisions regarding legacy permits \u2013 permits granted under former legal regime \u2013 which prohibits the amendment of permits to include new load points and limits the inclusion of new offtakers to those who were included in the original expansion plan of the permit. In connection therewith, the COFECE issued a recommendation stating that such resolution must be submitted to a Regulatory Impact Analysis before the National Commission for Regulatory Improvement, before being published in the Federal Official Gazette, since the resolution has anti-competitive effects to the detriment of private generators.<\/span><\/p>\n<p class=\"x_MsoNormal\"><span lang=\"EN-US\">This last measure is consistent with a memorandum from the President stating that Mexico might need to change its energy policy to be able to rescue state production companies Petr\u00f3leos Mexicanos (PEMEX) as CFE, going as far as to suggest a constitutional change to the energy reform is not off the table.<\/span><\/p>\n<p class=\"x_MsoNormal\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<p class=\"x_MsoNormal\"><strong>Suprema Corte confirma suspensi\u00f3n de pol\u00edtica el\u00e9ctrica<\/strong><\/p>\n<p class=\"x_MsoBodyTextIndent\">Con fecha 21 de octubre de 2020, la Suprema Corte de Justicia de la Naci\u00f3n confirm\u00f3 la suspensi\u00f3n derivada de la controversia constitucional impuesta por la Comisi\u00f3n Federal de Competencia Econ\u00f3mica (\u201cla \u201c<b><u>COFECE<\/u><\/b>\u201d) el 22 de junio de 2020. Dicha controversia constitucional argumentaba que la \u201c<i>Pol\u00edtica de Confiabilidad, Seguridad, Continuidad y Calidad en el Sistema El\u00e9ctrico Nacional\u201d<\/i>\u00a0(el \u201c<b><u>Acuerdo SENER<\/u><\/b>\u201d)\u00a0viola principios fundamentales de competencia y libre concurrencia que est\u00e1n establecidos en la Constituci\u00f3n Pol\u00edtica de los Estados Unidos Mexicanos. Por lo tanto, el Acuerdo SENER permanecer\u00e1 suspendido hasta que se emita una resoluci\u00f3n final en el procedimiento.<\/p>\n<p class=\"x_MsoBodyTextIndent\">El Acuerdo SENER ha sido la muestra m\u00e1s significativa de c\u00f3mo la pol\u00edtica energ\u00e9tica del actual gobierno mexicano tiene como objetivo fortalecer a la Comisi\u00f3n Federal de Electricidad (la \u201c<b><u>CFE<\/u><\/b>\u201d) para que domine el mercado el\u00e9ctrico, en lugar de que el mercado se rija por los criterios de libre competencia contenidos en las disposiciones legales aplicables al sector el\u00e9ctrico. Dicho acuerdo limita la interconexi\u00f3n de centrales el\u00e9ctricas renovables para dar prioridad a centrales el\u00e9ctricas convencionales de la CFE. Asimismo, impone barreras para la emisi\u00f3n de nuevos permisos de generaci\u00f3n, al mismo tiempo que fortalece las funciones de la Secretar\u00eda de Energ\u00eda, el Centro Nacional de Control Energ\u00eda (CENACE)<b>\u00a0<\/b>y la CFE para planear y operar la red el\u00e9ctrica.<\/p>\n<p class=\"x_MsoNormal\">Otros acontecimientos recientes incluyen una resoluci\u00f3n emitida por la Comisi\u00f3n Reguladora de Energ\u00eda el 7 de octubre de 2020 por la que se modifica la regulaci\u00f3n previa respecto de permisos legados \u2013 aquellos otorgados bajo la ahora abrogada ley \u2013 para prohibir la alta a nuevos centros de carga y limitar la inclusi\u00f3n de nuevos socios autoconsumidores, para que s\u00f3lo puedan incluirse aquellos que se encuentran en el plan de expansi\u00f3n original previsto en el permiso. Al respecto, la COFECE recomend\u00f3 someter el anteproyecto a un An\u00e1lisis de Impacto Regulatorio ante la Comisi\u00f3n Nacional Reguladora de Mejora Regulatoria, antes de ser publicado en el Diario Oficial de la Federaci\u00f3n, por representar efectos anticompetitivos en detrimento de generadores privados.<\/p>\n<p class=\"x_MsoNormal\">Esta \u00faltima medida es consistente con el memor\u00e1ndum del Presidente circulado el 22 de julio de 2020.
