Mercado de Abastecimiento y Distribuci\u00f3n de Bienes de Consumo<\/u><\/strong><\/p>\n

Investigaci\u00f3n por pr\u00e1cticas monop\u00f3licas relativas<\/strong> en el mercado de abastecimiento y distribuci\u00f3n al mayoreo de bienes de consumo, comercializaci\u00f3n minorista de \u00e9stos y servicios relacionados.<\/strong><\/p>\n

El 26 de noviembre de 2020, la Comisi\u00f3n Federal de Competencia Econ\u00f3mica (Comisi\u00f3n) inform\u00f3, a trav\u00e9s de un aviso en el Diario Oficial de la Federaci\u00f3n, del inicio de una investigaci\u00f3n por la posible comisi\u00f3n de pr\u00e1cticas monop\u00f3licas relativas conocidas como ventas atadas y la elevaci\u00f3n de costos a rivales, en el mercado de abastecimiento y distribuci\u00f3n al mayoreo de bienes de consumo, comercializaci\u00f3n minorista de \u00e9stos y servicios relacionados.<\/strong><\/p>\n

Es importante mencionar que la Comisi\u00f3n public\u00f3 un estudio de competencia en el mercado de alimentos y bebidas en el que se\u00f1ala \u201cque las grandes cadenas minoristas pueden imponer t\u00e9rminos y condiciones sobre sus proveedores (como retrasar los pagos o aplicar descuentos a estos), y agrega que este tipo de conductas genera incertidumbre a los peque\u00f1os proveedores y les transfiere el riesgo de que no se vendan los productos que el minorista ya adquiri\u00f3, lo que impacta negativamente en sus finanzas.<\/em>\u201d<\/p>\n

La investigaci\u00f3n inici\u00f3 el 24 de julio de 2020 y \u00a0tendr\u00e1 un plazo de 30 a 120 d\u00edas h\u00e1biles (con cuatro posibles extensiones del periodo de 120 d\u00edas, cada una).<\/p>\n

Las multas por este tipo de pr\u00e1cticas pueden ser de hasta el 8% de los ingresos de las empresas.<\/p>\n

Supply and Distribution of Consumer Goods Market<\/u><\/strong><\/p>\n

Investigation regarding vertical restraints <\/strong>in the market of supply and wholesale distribution of consumer goods,\u00a0 their retail marketing, and other related services.<\/strong><\/p>\n

On November 26, 2020, the Mexican Antitrust Commission (Commission) reported in the Official Gazette, the initiation of an investigation regarding potential tied sales and raising rivals\u2019 costs conducts known as vertical restraints, in the market of supply and wholesale distribution of consumer goods, the retail marketing of such goods, and other related services. <\/strong><\/p>\n

It is important to point out that the Commission published an analysis of competition in the food and beverage \u00a0market, in which it states: \u201clarge retail chains can impose terms and conditions on their suppliers (such as delaying payments or applying discounts), and adds that this type of behavior creates uncertainty for small suppliers and transfers to them the risk of not selling the products that the retailer already purchased, which negatively impacts their finances<\/em>.\u201d<\/p>\n

The investigation began on July 24, 2020 and should take from 30 to 120 business days (with four possible extensions of the 120-day period, each).<\/p>\n

Fines for such practices can be up to 8% of the companies\u2019 income.<\/p>\n
