{"id":18204,"date":"2025-08-08T10:53:24","date_gmt":"2025-08-08T16:53:24","guid":{"rendered":"https:\/\/www.nhg.mx\/?p=18204"},"modified":"2025-08-08T10:54:01","modified_gmt":"2025-08-08T16:54:01","slug":"nueva-ley-en-materia-de-telecomunicaciones-y-radiodifusion","status":"publish","type":"post","link":"https:\/\/www.nhg.mx\/es\/nueva-ley-en-materia-de-telecomunicaciones-y-radiodifusion\/","title":{"rendered":"Nueva ley en materia de telecomunicaciones y radiodifusi\u00f3n"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">El Congreso de la Uni\u00f3n aprob\u00f3 una nueva Ley en Materia de Telecomunicaciones y Radiodifusi\u00f3n\u00a0<\/span><b>(\u201cLMTR\u201d)<\/b><span style=\"font-weight: 400;\">, misma que fue publicada en el Diario Oficial de la Federaci\u00f3n y entr\u00f3 en vigor el 17 de julio de 2025.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La LMTR introduce cambios relevantes en las siguientes \u00e1reas:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Redise\u00f1o institucional<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Se extingue el Instituto Federal de Telecomunicaciones\u00a0<\/span><b>(\u201cIFT\u201d)<\/b><span style=\"font-weight: 400;\">\u00a0y se crea la Comisi\u00f3n Reguladora de Telecomunicaciones\u00a0<\/span><b>(\u201cCRT\u201d)<\/b><span style=\"font-weight: 400;\">, un organismo desconcentrado de la Agencia de Transformaci\u00f3n Digital y Telecomunicaciones\u00a0<\/span><b>(ATDT)<\/b><span style=\"font-weight: 400;\">. La CRT asume las funciones del IFT y tendr\u00e1 facultades para regular las telecomunicaciones, la radiodifusi\u00f3n y los servicios digitales.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>2.\u2002Nuevos sujetos regulados<\/b><\/p>\n<p><span style=\"font-weight: 400;\">La LMTR regula tres nuevos entes:<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><b>Proveedores de infraestructura pasiva<\/b><span style=\"font-weight: 400;\">, sujetos de nueva regulaci\u00f3n para la instalaci\u00f3n, despliegue, reordenamiento y retiro de infraestructura, y prestaci\u00f3n de servicios.<\/span><\/li>\n<li><b>Operadores de plataformas y servicios digitales de cualquier tipo<\/b><span style=\"font-weight: 400;\">(contenido, streaming, comida, movilidad, entre otros), quienes tendr\u00e1n que cumplir con obligaciones \u00a0espec\u00edficas de: i) no transmitir en sus plataformas ning\u00fan tipo de publicidad de gobiernos extranjeros, salvo promociones culturales, tur\u00edsticas y deportivas, ii) atender mandamientos de autoridades penales, fiscales y administrativas, y la facultad de dichas autoridades para recabar informaci\u00f3n sobre usuarios o clientes, y iii) la existencia de sanciones monetarias por incumplir estas obligaciones. \u00a0<\/span><\/li>\n<li><b>El Estado Mexicano<\/b><span style=\"font-weight: 400;\">, en su car\u00e1cter de competidor en la provisi\u00f3n de servicios de internet y conectividad.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><b>3.\u2002Nuevas reglas de infraestructura\u00a0<\/b><span style=\"font-weight: 400;\">(incluyendo fibra \u00f3ptica y centros de datos)<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">La infraestructura pasiva y activa ser\u00e1 objeto de nuevas reglas para su instalaci\u00f3n, despliegue, manenimiento, reordenaci\u00f3n y desmantelamiento, mientras que los proveedores de esa infraestructura tendr\u00e1n nuevas obligaciones de reporte, monitoreo y sanciones econ\u00f3micas en caso de incumplimiento.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>4.\u2002Otros aspectos relevantes<\/b><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><b>\u2002Regulaci\u00f3n satelital<\/b><span style=\"font-weight: 400;\">. La LMTR incluye nuevas normas para regular servicios satelitales, sostenibilidad espacial y comunicaciones con plataformas de gran altitud.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">\u2002<\/span><b>Poder sustancial<\/b><span style=\"font-weight: 400;\">, preponderancia e insumos esenciales. La Comisi\u00f3n Nacional Antimonopolio tendr\u00e1 atribuciones para declarar la existencia de poder sustancial, preponderancia e insumos esenciales en los sectores de radiodifusi\u00f3n y telecomunicaciones. Corresponder\u00e1 a la CRT vigilar y supervisar su cumplimiento.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">\u2002<\/span><b>Nuevas figuras legales<\/b><span style=\"font-weight: 400;\">. Se crean nuevas licencias y autorizaciones, incluyendo: a) la existencia de constancia de registro de operaci\u00f3n, aplicable a sistemas aeron\u00e1uticos, equipos o aparatos utilizados en eventos especiales, as\u00ed como dispositivos emisores y receptores de se\u00f1ales, b) nuevas categor\u00edas de servicios requerir\u00e1n de autorizaci\u00f3n, y c) las redes de radiocomunicaciones inteligentes deber\u00e1n contar con un t\u00edtulo de concesi\u00f3n.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><b>5.\u2002Licitaci\u00f3n de espectro 5G \u00a0<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Como una de las prioridades de la CRT, \u00e9sta deber\u00e1 emitir, en un plazo de 180 d\u00edas, un plan para la licitaci\u00f3n del espectro destinado a servicios 5G.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>***<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Nader, Hayaux &amp; Goebel cuenta con un equipo especializado para acompa\u00f1ar a su empresa en este proceso. Nuestro equipo est\u00e1 disponible para brindar asesor\u00eda espec\u00edfica o dise\u00f1ar planes de acci\u00f3n a la medida para adecuarse al nuevo marco normativo.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Para m\u00e1s informaci\u00f3n o para agendar una reuni\u00f3n, no dude en ponerse en contacto con nosotros.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>NEW LAW IN TELECOMMUNICATIONS AND BROADCASTING<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Mexico\u00b4s Congress has approved a new Legislation on Telecommunications and Broadcasting\u00a0<\/span><b>(\u201cLMTR\u201d)<\/b><span style=\"font-weight: 400;\">, which was published in the Official Gazette and came into force on July 17, 2025.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">LMTR introduces significant changes in the following areas:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>1.\u2002Institutional redesign<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The Federal Telecommunications Institute\u00a0<\/span><b>(\u201cIFT\u201d)<\/b><span style=\"font-weight: 400;\">\u00a0will be replaced by the Telecommunications Regulatory Commission\u00a0<\/span><b>(\u201cCRT\u201d)<\/b><span style=\"font-weight: 400;\">, a desconcentrated entity under the Agency for Digital Transformation and Telecommunications. The CRT will assume the powers previously held by the IFT and will regulate telecoms, broadcasting and digital services.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>2.\u2002New regulated entities<\/b><\/p>\n<p><span style=\"font-weight: 400;\">LMTR includes three new regulated entities:<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">\u2002<\/span><b>Providers of passive infrastructure<\/b><span style=\"font-weight: 400;\">, which will be subject to new rules for the installation, deployment, maintenance and dismantling of telecom infrastructure, and the provision of services.<\/span><\/li>\n<li><b>Operators of digital platforms and digital services of any kind<\/b><span style=\"font-weight: 400;\">(content, streaming, food, mobility, among others), that must comply with specific obligations of: i) not transmitting on their platforms any type of advertising from foreign governments, except for cultural, tourism and sports purposes, ii) complying with mandates from criminal, tax and administrative authorities, and the power of said authorities to collect information about their users or clients, and iii) the existence of monetary penalties for failing to comply with these obligations. \u00a0<\/span><\/li>\n<li><b>\u2002The State<\/b><span style=\"font-weight: 400;\">, when will become a market participant in the services of internet access and connectivity.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><b>3.\u2002New rules on infrastructure<\/b><span style=\"font-weight: 400;\">\u00a0(including fiber and data centers)<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Passive and active infrastructure will be subject to greater obligations for their installation, deployment, maintenance, reorganization and dismantling, and there will be new reporting and monitoring obligations, and economic sanctions in case of non-compliance.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>4.\u2002Other key changes<\/b><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">\u2002<\/span><b>Satellite regulation.<\/b><span style=\"font-weight: 400;\">LMTR includes rules on satellite services, space sustainability and communications with High-Altitude Platforms.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">\u2002<\/span><b>Substantial power<\/b><span style=\"font-weight: 400;\">, preponderance and essential incomes. The National Competition Agency will have the authority to declare or determine substantial power, preponderance and essential incomes, whereas the CRT will monitor and sanction the entities subject to those regimes.<\/span><\/li>\n<li><b>\u2002New type of licenses<\/b><span style=\"font-weight: 400;\">. A registration certificate will be required for i) aeronautical systems, ii) equipment or devices used in special events (sporting and cultural) and iii) the emission and reception of radiocommunication signals. Specific types of telecom services will require authorization, and smart radiocommunication networks will require a government license.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><b>5.\u20025G Auction \u00a0<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">As one of the priorities of the CRT, LMTR provides for the issuance of a 5G spectrum auction plan within 180 days.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">***<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nader, Hayaux &amp; Goebel cuenta con un equipo especializado para acompa\u00f1ar a su empresa en este proceso.
