{"id":18768,"date":"2026-01-28T13:26:13","date_gmt":"2026-01-28T19:26:13","guid":{"rendered":"https:\/\/www.nhg.mx\/?p=18768"},"modified":"2026-01-28T13:28:47","modified_gmt":"2026-01-28T19:28:47","slug":"meses-decisivos-regularizacion-de-derechos-del-agua","status":"publish","type":"post","link":"https:\/\/www.nhg.mx\/es\/meses-decisivos-regularizacion-de-derechos-del-agua\/","title":{"rendered":"Meses decisivos: Regularizaci\u00f3n de derechos del agua"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">A partir del 28 de octubre de 2025, fecha en la que se public\u00f3 en el Diario Oficial de la Federaci\u00f3n el Decreto por el que se establecen facilidades administrativas para regularizar los t\u00edtulos de concesi\u00f3n y asignaci\u00f3n otorgados a los usuarios de aguas nacionales que se indican y durante los siguientes tres meses, aquellas concesiones de aguas nacionales para usos dom\u00e9stico, agr\u00edcola, pecuario, de acuacultura, y asignaciones para uso p\u00fablico urbano, cuya vigencia hubiesen expirado entre el 1 de octubre de 2017 y el 1 de marzo de 2025, podr\u00e1n ser renovadas, a pesar de no haber sido prorrogadas conforme a los plazos de ley, siempre y cuando se cumplan con los siguientes criterios de elegibilidad:<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Calidad del solicitante.<\/b><span style=\"font-weight: 400;\">\u00a0Reunir el criterio de titularidad de la concesi\u00f3n o asignaci\u00f3n correspondiente, o de causahabiencia por sucesi\u00f3n. Si el titular de la concesi\u00f3n falleci\u00f3, los t\u00edtulos pueden ser objeto de regularizaci\u00f3n siempre que se acrediten derechos sucesorios.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Continuidad.\u00a0<\/b><span style=\"font-weight: 400;\">Debe existir continuidad en el ejercicio de los derechos de explotaci\u00f3n, uso y\/o aprovechamiento de aguas nacionales durante los \u00faltimos dos a\u00f1os, acreditando adem\u00e1s que las obras de extracci\u00f3n se encuentran debidamente equipadas para su operaci\u00f3n.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Derechos inmobiliarios.\u00a0<\/b><span style=\"font-weight: 400;\">Acreditar la propiedad o la posesi\u00f3n de los predios en los que se ubiquen las obras de extracci\u00f3n. \u00a0<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Umbral volum\u00e9trico.\u00a0<\/b><span style=\"font-weight: 400;\">Para el caso de concesiones, los t\u00edtulos no deben exceder de 500,000 m\u00b3\u00a0anuales. En el caso de asignaciones en favor de entidades federativas o municipios, la regularizaci\u00f3n aplica a todos los t\u00edtulos sin l\u00edmite en el volumen.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Existencia de antecedentes registrales.<\/b><span style=\"font-weight: 400;\">\u00a0Los t\u00edtulos deber\u00e1n contar con asiento registral o antecedente en el Registro P\u00fablico de Derechos de Agua.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Oportunidad.\u00a0<\/b><span style=\"font-weight: 400;\">La adhesi\u00f3n al decreto podr\u00e1 hacerse hasta el 28 de abril de 2026. Las solicitudes de regularizaci\u00f3n presentadas fuera de este plazo ser\u00e1n improcedentes.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">La regularizaci\u00f3n ser\u00e1 improcedente en aquellos casos claramente establecidos en el decreto.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Los t\u00edtulos que se regularicen mediante la adhesi\u00f3n al decreto no podr\u00e1n ser objeto de un cambio en el uso de agua. En la resoluci\u00f3n se tomar\u00e1 en cuenta la disponibilidad del recurso seg\u00fan los Acuerdos publicados en el Diario Oficial de la Federaci\u00f3n.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">En Nader, Hayaux &amp; Goebel contamos con un equipo de abogados especializados en derecho administrativo y recursos h\u00eddricos que puede responder a sus dudas o inquietudes sobre el decreto, as\u00ed como brindar el acompa\u00f1amiento legal necesario para regularizar su t\u00edtulo.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Cont\u00e1ctenos en\u00a0<\/span><a href=\"mailto:equipoambiental@nhg.com.mx?subject=&amp;body=\"><span style=\"font-weight: 400;\">equipoambiental@nhg.com.mx<\/span><\/a><\/p>\n<p>&nbsp;<\/p>\n<h4><b>Critical Months Ahead: An Exceptional Window to Regularize Water Rights<\/b><\/h4>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">As of October 28, 2025, when the decree establishing administrative simplification measures for the regularization of concession and allocation titles granted to listed national water users was published in the Official Gazette of the Federation and throughout the next three months, waters concession titles allocated for domestic, agricultural, livestock, and aquaculture use, as well as water right titles granted for urban public use, whose term expired between October 1, 2017 and March 1, 2025 may be renewed, despite not been extended in due time pursuant to applicable legal provisions, provided the following eligibility criteria is met:<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Legal standing.<\/b><span style=\"font-weight: 400;\">\u00a0Petitioners must be holders of title of water rights or legal successors thereof. If the concession titleholder is deceased, but succession rights can be evidenced, the water rights titles may be subject to renewal.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Continuity\u00a0<\/b><span style=\"font-weight: 400;\">in the exercise of the exploitation, use, or harness of water rights for the past two years. Additionally, the petitioner must demonstrate that the extraction points are properly equipped for their operation.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Real estate rights.<\/b><span style=\"font-weight: 400;\">\u00a0Petitioners must prove ownership or possession of the property on which the extraction point is located.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Volume threshold.<\/b><span style=\"font-weight: 400;\">\u00a0Concession titles shall not exceed 500,000 m\u00b3 per\u00a0year. For water allocations in favor of states or municipalities, all titles are eligible for regularization without any volume limitation.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Previous registration history.\u00a0<\/b><span style=\"font-weight: 400;\">The titles must be registered or hold a record in the Public Registry for Water Rights.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Timeliness.\u00a0<\/b><span style=\"font-weight: 400;\">Adherence to the decree may occur until April 28, 2026. Any petition for regularization filed thereafter will be inadmissible.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Regularization will be rejected in those cases clearly outlined in the decree.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Regularized titles as per the decree cannot be subject to water use changes.
