{"id":5478,"date":"2023-04-05T17:30:04","date_gmt":"2023-04-05T22:30:04","guid":{"rendered":"https:\/\/www.nhg.mx\/?p=5478"},"modified":"2023-04-05T17:41:34","modified_gmt":"2023-04-05T22:41:34","slug":"iniciativa-con-proyecto-de-decreto-por-el-que-se-reforman-adicionan-y-derogan-diversas-disposiciones-en-materia-administrativa","status":"publish","type":"post","link":"https:\/\/www.nhg.mx\/es\/iniciativa-con-proyecto-de-decreto-por-el-que-se-reforman-adicionan-y-derogan-diversas-disposiciones-en-materia-administrativa\/","title":{"rendered":"Iniciativa con proyecto de decreto por el que se reforman, adicionan y derogan diversas disposiciones en materia administrativa"},"content":{"rendered":"<p>El 24 de marzo de 2023, el presidente de M\u00e9xico envi\u00f3 a la C\u00e1mara de Diputados la iniciativa con proyecto de decreto por medio de la cual se reforman, adicionan y derogan diversas disposiciones en materia administrativa.<br \/>\nDe acuerdo con la exposici\u00f3n de motivos, la iniciativa busca principalmente (i) revertir actos de corrupci\u00f3n, (ii) salvaguardar las finanzas p\u00fablicas, y (iii) fortalecer a la administraci\u00f3n p\u00fablica federal, para lo cual propone diversas reformas en materia administrativa, incluyendo la siguientes:<\/p>\n<ul>\n<li>Reformar la Ley Federal de Procedimiento Administrativo para incluir como causales de revocaci\u00f3n de concesiones, autorizaciones, permisos y licencias los hechos o actos supervenientes que afecten el inter\u00e9s p\u00fablico, general o social, la seguridad nacional o que causen desequilibrio o da\u00f1o econ\u00f3mico, social, ambiental o que impidan el disfrute de derechos fundamentales de las personas f\u00edsicas. Se propone que no proceda el resarcimiento de da\u00f1os o perjuicio cuando, entre otros: (i) la revocaci\u00f3n o terminaci\u00f3n anticipada est\u00e1 motivada en el inter\u00e9s p\u00fablico, general o social, o en la preservaci\u00f3n de los bienes comunes, o en la seguridad e integridad de las personas e instituciones nacionales; o (ii) se haya recuperado la inversi\u00f3n.<\/li>\n<li>Reformar la Ley Federal de las Entidades Paraestatales, facultando al Ejecutivo Federal para asignar a las entidades paraestatales, directa e indefinidamente, la prestaci\u00f3n de servicios p\u00fablicos, as\u00ed como el uso, aprovechamiento y explotaci\u00f3n de bienes sujetos al r\u00e9gimen del dominio p\u00fablico por causas de utilidad e inter\u00e9s p\u00fablico, general, social o de seguridad nacional.<\/li>\n<li>Reformar la Ley de Adquisiciones, Arrendamientos y Servicios del Sector P\u00fablico a efecto de permitir anticipos a proveedores hasta por un 50% del monto total del contrato, y hasta m\u00e1s del 50% cuando se trate de adquisici\u00f3n de insumos y equipos m\u00e9dicos, equipos para la seguridad nacional o p\u00fablica, y maquinaria para el desarrollo y mantenimiento de infraestructura que se requiera para la prestaci\u00f3n de servicios p\u00fablicos, justificados por la pronta entrega o precio inferior al del mercado.<\/li>\n<li>Reformar la Ley de Adquisiciones, Arrendamientos y Servicios del Sector P\u00fablico para reducir requisitos de licitaciones internacionales abiertas, y permitirlas cuando (i) la investigaci\u00f3n de mercado acredite que internacionalmente se obtienen mejores condiciones, (ii) la investigaci\u00f3n de mercado advierta que no existe oferta de proveedores nacionales, o (iii) se acredite colusi\u00f3n o conturbernio para obligar a la Administraci\u00f3n P\u00fablica a adquirir bienes o servicios que no aseguren las mejores condiciones.<\/li>\n<li>Reformar la Ley de Obras P\u00fablicas y Servicios Relacionadas con las Mismas, requiriendo que se incluya en todos los contratos la \u201ccl\u00e1usula exorbitante\u201d, mediante la cual se establece la suspensi\u00f3n temporal y terminaci\u00f3n anticipada de contratos en casos de inter\u00e9s general, causas justificadas o si se puede causar un perjuicio al Estado, como lo establece actualmente el art\u00edculo 60 de dicha ley. Asimismo, se modifica para agilizar la ejecuci\u00f3n de trabajos que se requieran por (i) evidente urgencia, (ii) prioridad para el ejercicio de derechos sociales y el desarrollo econ\u00f3mico, y (iii) la defensa de la soberan\u00eda y la seguridad nacional, permitiendo a las dependencias p\u00fablicas correspondientes obtener los permisos y derechos de propiedad necesarios de manera simult\u00e1nea al inicio de obra.<\/li>\n<li>Modificar la Ley Federal de Procedimiento Contencioso Administrativo para reglamentar la figura del \u201cJuicio de Lesividad\u201d como instrumento para demandar la nulidad de una resoluci\u00f3n administrativa favorable a un particular, contraria a la ley, o que cause un perjuicio a la Administraci\u00f3n P\u00fablica Federal o al inter\u00e9s p\u00fablico.<\/li>\n<li>Modificar la Ley de Expropiaci\u00f3n a efecto de derogar la disposici\u00f3n que prev\u00e9 la aplicaci\u00f3n de dicha ley sin perjuicio de lo dispuesto por los tratados internacionales de los que M\u00e9xico sea parte y acuerdos arbitrales.<\/li>\n<li>Modificar la Ley General de Bienes Nacionales para establecer un procedimiento expedito de recuperaci\u00f3n por la v\u00eda administrativa de los bienes sujetos al r\u00e9gimen de dominio p\u00fablico de la Federaci\u00f3n.<\/li>\n<li>Facultar al Ejecutivo Federal para agrupar a las entidades paraestatales atendiendo al inter\u00e9s p\u00fablico, general, social o de seguridad nacional.<\/li>\n<li>Crear los conceptos de \u201cintegraci\u00f3n\u201d y \u201creintegraci\u00f3n\u201d, mediante los cuales se faculta a la SHCP para proponer al Ejecutivo Federal la transferencia parcial o total de facultades, personal y recursos patrimoniales de las dependencias de la Administraci\u00f3n P\u00fablica Federal, permitiendo al Ejecutivo Federal determinar la dependencia a la que se har\u00e1 la integraci\u00f3n o reintegraci\u00f3n correspondiente.<\/li>\n<\/ul>\n<p>La iniciativa se encuentra actualmente en revisi\u00f3n por la C\u00e1mara de Diputados, y posteriormente deber\u00e1 enviarse a la C\u00e1mara de Senadores para su revisi\u00f3n. Al no tratarse de una reforma constitucional, la iniciativa requiere ser aprobada \u00fanicamente por la mayor\u00eda simple de ambas c\u00e1maras.<br \/>\nSeguiremos de cerca el progreso en la revisi\u00f3n de la iniciativa y los mantendremos informados de su potencial impacto en caso de ser aprobada.<\/p>\n<p>En caso de tener cualquier duda, favor de contactar a <strong>Javier Arreola<\/strong> <a href=\"mailto:jarreola@nhg.com.mx\">jarreola@nhg.com.mx<\/a>, <strong>Santiago Medina<\/strong> <a href=\"mailto:smedina@nhg.com.mx\">smedina@nhg.com.mx<\/a> o <strong>Ana Mar\u00eda Alp\u00edzar<\/strong> <a href=\"mailto:aalpizar@nhg.com.mx\">aalpizar@nhg.com.mx<\/a>.<\/p>\n<p><strong>Initiative with draft decree reforming, adding and repealing several provisions in administrative matters<\/strong><\/p>\n<p>On March 24, 2023, the president of Mexico sent to the Chamber of Deputies an initiative with a proposed decree to amend, supplement or repeal various provisions of administrative laws.<\/p>\n<p>According to the explanatory statement of the initiative, it mainly seeks to (i) reverse acts of corruption, (ii) safeguard the public finances, and (iii) strengthen the federal public administration, and for such purposes, it proposes several administrative reforms, including the following:<\/p>\n<ul>\n<li>Reform the Federal Law of Administrative Procedures to include as grounds for revocation of concessions, authorizations, permits and licenses any supervening acts that affect the public, general or social interest, national security or that cause imbalance or economic, social or environmental damage, or that prevent the enjoyment of fundamental rights of individuals. It is proposed that compensation for damages or harm is not to be applicable when, among others: (i) the revocation or early termination is motivated by the public, general or social interest, or by the preservation of common good, or by security and integrity of individuals and national institutions; or (ii) the investment has been recovered.<\/li>\n<li>Reform the Federal Law of Parastatal Entities, allowing the Federal Executive Branch to assign to parastatal entities, directly and indefinitely, the provision of public services, as well as the use and exploitation of assets subject to the public domain regime for reasons of utility and public, general or social interest or national security.<\/li>\n<li>Reform the Public Sector Acquisitions, Leases and Services Law in order to allow advance payments to suppliers for up to 50% of the total amount of the contract, and up to more than 50% when it comes to the acquisition of medical supplies and equipment, equipment for national or public security, and machinery for the development and maintenance of infrastructure required for the provision of public services, justified by prompt delivery or lower-than-market prices.<\/li>\n<li>Reform the Public Sector Acquisitions, Leasing and Services Law to reduce the requirements for open international tenders, and allow such when (i) market study proves the existence of better international conditions, (ii) market study identifies there is no offer from national suppliers, or (iii) collusion or conspiracy is proven to force the Public Administration into acquiring goods or services that do not guarantee the best conditions.<\/li>\n<li>Reform the Public Works and Related Services Law, requiring the inclusion of the &#8220;exorbitant clause&#8221; in all contracts, which provides for the temporary suspension and early termination of contracts due to general interest, justified causes or if damage can be caused to the State, as currently established in article 60 of said law. Furthermore, it is modified to expedite the execution of works that are required due to (i) evident urgency, (ii) the exercise of social rights and economic development, and (iii) the defense of sovereignty and national security, allowing the corresponding public entites to obtain the necessary permits and property rights simultaneously with the start of the work.<\/li>\n<li>Modify the Federal Law of Administrative Procedures to regulate the concept of &#8220;Juicio de Lesividad&#8221; as the legal instrument to request the annulment of an administrative resolution issued to favor an individual, contrary to the law, or that causes damage to the Federal Public Administration or to the public interest.<\/li>\n<li>Modify the Expropriation Law in order to repeal the provision that provides for the application of said law without prejudice to the international treaties to which Mexico is a party and other arbitration agreements.<\/li>\n<li>Modify the General Law of National Assets to establish an expedite procedure for the administrative recovery of assets subject to the Federal regime of public domain.<\/li>\n<li>Allow the Federal Executive Branch to group parastatal entities in response to the public, general, social interest or national security.<\/li>\n<li>Create the concepts of &#8220;integration&#8221; and &#8220;reintegration&#8221; through which the Ministry of Finances and Public Credit is allowed to propose to the Federal Executive Branch the partial or total transfer of authority, personnel and resources of the entities of the Federal Public Administration, allowing the Executive Federal Branch to determine the entity in which the corresponding integration or reintegration will be completed.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>The initiative is currently under review by the Chamber of Deputies, and subsequently will be sent to the Senate for review.
